These Terms of Service ("Terms") govern the purchase of commercial restaurant and foodservice equipment and supplies from Fort Smith Restaurant Supply Company ("we," "us," or "our"), located at 930 Phoenix Ave, Fort Smith, AR 72901. By submitting an inquiry, placing an order, or otherwise engaging with our business, you agree to these Terms.
Fort Smith Restaurant Supply Company is a business-to-business (B2B) distributor of commercial restaurant and foodservice equipment and supplies, serving restaurants, hotels, hospitals, schools, nursing homes, casinos, clubs, and other commercial and institutional customers. We sell both new and used equipment and provide equipment parts, delivery, and applicable service.
Product and equipment information provided on this website, by email, or by phone is general in nature. Specific pricing, specifications, and availability are provided upon request and are subject to change without notice. Quotes are valid only for the period specified at the time they are issued and do not constitute a binding offer until accepted in writing by both parties.
All orders are subject to product availability and our acceptance. We reserve the right to accept, decline, or cancel any order at our discretion, including in cases of pricing errors, inventory changes, or inability to fulfill an order as requested. Confirmation of an order does not guarantee a specific delivery date unless separately agreed in writing.
Used equipment is sold on an as-available basis. Condition, specifications, pricing, and warranty status of used equipment vary by item and will be disclosed to the customer prior to purchase to the extent known. Used equipment is sold "as-is" unless a specific warranty is expressly provided in writing at the time of sale.
Unless otherwise agreed in writing, orders are invoiced and payment is due according to the terms stated on the applicable invoice. A deposit may be required prior to order processing or fulfillment for certain orders, particularly special-order or custom equipment. Full payment may be required prior to delivery or pickup.
Delivery arrangements, timing, and any associated charges will be communicated to the customer at the time of order. Delivery dates are estimates and are not guaranteed unless separately agreed in writing. Risk of loss or damage transfers to the customer upon delivery, unless otherwise specified.
We assist customers with sourcing equipment parts and, where applicable, connecting customers with service for their equipment. Availability of parts and service depends on the equipment type, age, and manufacturer, and is not guaranteed. We do not represent that we are an authorized manufacturer service provider or certified repair center for any specific brand unless expressly stated in writing for a particular transaction.
Requests to change or cancel an order must be submitted in writing. Orders for special-order, custom, or non-stock equipment may not be eligible for cancellation once processing has begun. Deposits on cancelled orders may be non-refundable depending on the status of the order at the time of cancellation.
Returns, where applicable, are subject to approval and may be limited based on the type of product, its condition, and whether it is new, used, or special-order. Restocking fees may apply. Used equipment is generally not eligible for return once sold, except where a specific return allowance is agreed in writing.
Manufacturer warranties, where actually provided by the equipment manufacturer, apply according to the manufacturer's own warranty terms. Fort Smith Restaurant Supply Company does not independently extend, guarantee, or administer manufacturer warranties unless expressly stated in writing. Used equipment is sold without warranty unless a specific warranty is expressly provided at the time of sale.
To the fullest extent permitted by law, Fort Smith Restaurant Supply Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase, delivery, use, or servicing of equipment or supplies. Our total liability for any claim arising from a transaction shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
These Terms and any transaction with Fort Smith Restaurant Supply Company are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any disputes arising from these Terms or a transaction shall be resolved in the courts located in Sebastian County, Arkansas.
We may update these Terms from time to time. Changes will be reflected by an updated "Last updated" date at the top of this page.
